HOOPS B4 WORK PLAYERS IMPORTANT INFORMATION

 

Insurance: Participants and Players Personal injury insurance is not provided by Hoops B4 Work. Any player or Participant that may wish to be insured against personal injury; they are advised to arrange their own personal injury insurance to cover them participating in our classes/sessions and tournaments. Please note we are not in any position to advise what cover you may or may not require.

Waiver: By signing to play and participate in any of the Hoops B4 Work classes/sessions or physically taking part in any of our Tournaments you fully accept the following Waiver, Release of Liability, Assumption of Risk and Indemnity Agreement:

In consideration of me being allowed to participate in any way in the upcoming sessions/class, tournaments and social events provided and hosted by Hoops B4 Work I hereby acknowledge and agree as follows:

  1. I take full ownership of participating in any of the Hoops B4 Work activities provided. I believe when taking into consideration the classes, sessions, tournaments and any social events I am fully qualified to do so. This includes taking into consideration my health, ability and qualification that allows me to do so. I agree that I am fully capable to take part in any activity provided by Hoops B4 Work and have considered all the above before taking part. In addition, I acknowledge that I am aware that the Activities will be conducted in facilities open to the public. I further agree and warrant that if, at any time, I believe conditions to be unsafe, I will immediately discontinue further participation in the activities provided by Hoops B4 Work.
  2. I fully understand that: (a) the sessions, classes, tournaments and social events provided by Hoops B4 Work involve risks and dangers of serious bodily injury, including permanent disability, blindness, paralysis and death (“Risks”); (b) these Risks may be caused by my own actions, or inactions, the actions or inactions of others participating in the Activities, the conditions in which the Activities take place or the negligence of the Releasees (defined below); (c) there may be other risks and social and economic losses either not known to me or not readily foreseeable at this time; and (d) I fully accept and assume all such risks and all responsibilities for losses, costs, and damages incurred as a result of my participation in the Activities.
  3. I hereby release, discharge, covenant not to sue, and agree to hold harmless Hoops B4 Work, it’s owner(s), administrators, directors, officers, volunteers, and employees, other participants, any sponsors and advertisers, and, if applicable, owners and lessors of premises on which the Activities take place (each considered to be one of the “Releases” herein) from all liability, claims, demands, losses, or damages on account caused or alleged to be caused in whole or in part by the negligence of the Releases or otherwise, including rescue operations, and further agree that if, despite this release, I, or anyone on my behalf, makes a claim against any of the Releases named above.

I WILL INDEMNIFY, SAVE AND HOLD HARMLESS EACH OF THE RELEASEES FROM ANY LITIGATION EXPENSES, LOSS, LIABILITY, DAMAGES OR COSTS ANY MAY INCUR AS THE RESULT OF ANY SUCH CLAIM. I HAVE READ THIS AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, OR AGREEING TO THE STATEMENT AND HAVE  SIGNED IT FREELY AND WITHOUT ANY INDUCEMENT OR ASSURANCE OF ANY NATURE AND INTEND IT TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW AND AGREE THAT IF ANY PORTION OF THIS AGREEMENT IS HELD TO BE INVALID THAT THE BALANCE, NOTWITHSTANDING, SHALL CONTINUE IN FULL FORCE AND EFFECT.

NOTHING IN THESE TERMS AND CONDITIONS SHALL LIMIT OR EXCLUDE THE LIABILITY OF THE RELEASEES FOR ANY DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE.

THESE TERMS AND CONDITIONS SHALL BE GOVERNED BY AND INTERPRETED IN ACCORDANCE WITH ENGLISH LAW AND ALL PARTIES SUBMIT TO THE EXCLUSIVE JURISDICTION OF THE ENGLISH COURTS

Team Payments

You register a team by following the registration process for Teams. The Team Organiser/Captain will pay for their whole Team and recover the costs from their players individually. We request that you pay at the same time you register your team in order to secure your position in the league (by following the registration process to the end). We will hold your team’s place in the league until 10pm the following day after you registered. If we do not receive full payment for your team by 10pm the following day, your team’s position in the league will automatically be offered to the next team (either on the waiting list or re-marketed as spots available in the league). You can log-in to your control panel on the GO Mammoth website at any time, select MY STATEMENT, and process your payment.

The only exception to the above is for Organisations who have opted to pay by “bank transfer” – in which case, we allow 3 days for the payment to clear from the day you register. After which point, if funds are not received, will offer your team’s place to the next team. If you require an invoice please contact finance@gomammoth.co.uk

Team Captains / Organisers – adding players to roster:

As the team Organiser / Captain you are responsible for ensuring that all players participating are registered with GO Mammoth on our website. Additionally it is the Team Organiser / Captains responsibility to  inform all participating players in a team of GO Mammoth’s waiver of liability. Namely that all players need to have arranged their own personal injury insurance to cover them during their activity (should they wish) and that they fully accept the risks in participating and all responsibilities for losses, costs and damages incurred as a result of their participation in the activities.


Individual Payments

You register your interest in playing by following the registration process for Individuals. If there is a space available in a team for the league you selected, we will request that you pay the individual registration fee to confirm your position in the team. We will hold this place in the team until 10pm the following day after you registered. If payment is not received by 10pm the followig day, your place will automatically be offered to the next individual who registers. You can log-in to your control panel on the GO Mammoth website at any time, select MY STATEMENT, and process your payment. Alternatively, you can click the “Pay Now” link in the confirmation email you receive immediately upon completing your registration.

IMPORTANT: Your position in a league (whether a team or individual) IS ONLY CONFIRMED once your full league fees have been received by GO Mammoth.

Refunds

No refunds within 5 days of the originally posted start date of the league or class (no matter the circumstances – which includes but is not limited to illness and injury). For ALL refunds processed before this time, there will be a £15 processing fee for Individuals and a £30 processing fee for Teams.


Ringers/Forfeits

The most important thing for us, is that all of our teams get to play their games each week! For this reason, GO Mammoth follows a strict forfeit policy:

“If a team does not show up OR is unable to field a full squad for any 2 games within a season, we reserve the right to eject this team from the remainder of the season with NO REFUND.”

If you require ringers for a fixture, we can help you out with that. You just need to contact hello@gomammoth.co.uk or 0207 381 6034 with the details. If we still get a game going between you and your opposition, this will not be a strike for your team.

When a team does not arrive for a fixture against your own team or when they have forfeited with notice, GO Mammoth will make very effort to find a suitable opposition to fulfil a friendly fixture at the same time and location. Your team will receive a walkover victory in the league and will also get the opportunity to play. If no opposition is available to play the pitch is free for you to use, supervised by a GO Mammoth Rep who will support in running a small sided match or training session.

Player Conduct

We expect all players and teams to treat all other players, staff, and members of public at the league with respect at all times during our league events.

Any reports of player or team misconduct at the leagues will be investigated in depth but please note that we reserve the right to eject any players and/or teams whom we believe to have acted in a way that could compromise the safety and/ or social atmosphere of the leagues.

Nails, Piercings & Jewellery

Any jewellery/piercings must be removed before stepping on court and nails must be filed / cut short to ensure safety for all players. Any player who refuses to file/cut their nails or to remove items of jewellery/piercings will not be allowed to play in the game. Only specific Netball gloves are allowed for medical reasons and no tapping of jewellery/piercings is allowed.

Bad Weather

We appreciate players ultimately just want to play netball each week and inconsistencies with off-weeks is not ideal for anyone. Given we live in the UK, where weather can be very changeable, GO Mammoth’s general viewpoint is that it is better to get players out playing each week EVEN IF it’s wet/cold/rainy/slippery. Similar to school, once you’re running about and playing, you may need to be more conscientious/slow the game down, but it’s still essentially exercise with friends.

Below are the various scenarios for when games may be cancelled due to extreme weather:

Games cancelled in advance –  If games are cancelled in advance during the day you will usually be informed by 5pm on the day by email/sms. If this happens, your missed games will be rescheduled (extra week added on to the season) – so you will not miss any games overall. If you do not hear from us by 5pm, please ASSUME all games will be going ahead. We do speak with Venues throughout the day as well as looking at forecasts to determine whether games can go ahead.

Late notice cancellation – very occasionally the weather may deteriorate last minute which means the GO Mammoth umpire has to cancel games when you arrive or after games have already started. We try to minimise this scenario as much as possible for obvious inconveniences for players (and umpires), but when it does happen games not played will be rescheduled or credited. This decision to cancel games is completely at the discretion of GO Mammoth and feeds into the following point.

Team Forfeits – If you arrive at the venue and the GO Mammoth umpire has said it is playable but you disagree and/or do not wish to play e.g. it may be miserable/slippery/cold/wet etc, then this will be treated as a forfeit and fixtures will not be rescheduled or credits offered. In this instance, the GO Mammoth umpire is best placed to make the decision. Often some teams are happy to play in the conditions whilst others are not, so the last word is to the umpire.

Waiver of liability / Assumption of risk

THESE TERMS AND CONDITIONS SHALL BE GOVERNED BY AND INTERPRETED IN ACCORDANCE WITH ENGLISH LAW AND ALL PARTIES SUBMIT TO THE EXCLUSIVE JURISDICTION OF THE ENGLISH COURTS

  1. Membership Term and Fees
    1.1. Your membership will start the day you register and pay for your membership, unless otherwise specified during sign up.
    1.2. Membership Fees are payable every month in advance by recurring card payments unless terminated in accordance with clause 3.
    1.3. We reserve the right to increase the membership fees from time to time. You will be given 10 days prior written notice of such increases and should you decide not to accept such increases you may cancel your membership by notifying us in writing before the new fee rate commences.
    1.4. Multi Class Membership:
    1.4.1. As an Multi Class member, you may attend unlimited classes each week and you are guaranteed a place in your Primary class each week.
    1.4.2. To ensure bookings accurately reflect class attendance, and to keep as many open spaces as possible, you can book into up to 3 classes at any one time. Once a session has passed, you will be able to book into another class.
    1.5. Single Membership:
    1.5.1. As a Single Class member, you may attend one class a week.
    1.5.2. Your Primary class is the class you are automatically booked into every week, and you are guaranteed a place in this class.
    1.5.3. You can change this class either temporarily or permanently at any time online by going to your login and clicking on the My Classes tab on your control panel.
    1.5.4. If you cannot make a class, please swap out of the class into a class you can make. If you don’t swap your booked class before its start time, you will not be able to book another class that week.
  2. Trial Period
    2.1. All new members are granted a 5 day trial period, whereby members may cancel their membership within 5 days of their start date to receive a full refund on their first month’s membership.
    2.2. Upon request of cancellation, their membership will be terminated with immediate effect.
  3. Cancelling Membership
    3.1. To cancel a membership, members must complete an online cancellation form a minimum of 5 working days in advance of their next payment date. A cancellation form can be requested from GO Mammoth by calling 0207 381 6034 or by emailing memberships@gomammoth.co.uk. Any other forms of notification will not be accepted.
    3.2. Subject to termination or cancellation, no refund will be made in respect of the part of the relevant month falling after the date of termination.
  4. Freezing Memberships
    4.1. Members can freeze their membership for a minimum of 2 weeks, and a maximum of 4 weeks.
    4.2. A minimum of one weeks notice must be given, along with appropriate supporting documentation, ie; a screenshot of holiday flights or doctors note etc.
    4.3. Upon confirmation of the freeze, members will receive a refund equal to the period missed.
  5. Failed Payments
    5.1. If you fail to pay any amount due under this agreement for a period of more than 30 days, then we may pass the debt to a third party company for collection. The cost of this instruction will be borne by you, including costs in tracing you should you have changed address.
  6. Missed Classes
    6.1. As memberships are broken down into monthly payments, GO Mammoth will not compensate members who do not show up to sessions they have paid for.
  7. Class Timetable
    7.1. Occasionally due to reasons beyond our control, our timetable is subject to last minute changes. In every situation, we will endeavour to notify you as far in advance as possible.
    7.2. We reserve the right to cancel classes up to the class start time, whereby all members booked into that class will be notified and their booking removed.
    7.3. We cannot freeze memberships or refund for classes cancelled, and members are encouraged to book in to an alternative class.
  8. Public Holidays
    8.1. GO Mammoth do not run classes on Public Holidays and members are encouraged to book into an alternative class that week.
    8.2. Over the Christmas period (usually the last 2 weeks of the year), GO Mammoth don’t run any classes. Your membership will be put on hold for that period and you won’t be charged.

To enter a membership agreement with GO Mammoth, you accept the above Terms & Conditions.
